Terms of Service

These Terms of Service (“Terms”) govern your use of OAT — Overcut Academy Telemetry (“OAT”, “the App”, “the Service”), including its Free and Pro plans and its online features, published by Nogueira Driver Development LTDA, a company registered in Brazil and doing business as Overcut Academy (“we”, “us”). By creating an account, signing in or using OAT, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

OAT is free to use with a free account. Pro costs $29/month or $290/year and starts with a 30-day free trial — one per person, card required, and it becomes a paid subscription unless you cancel before it ends. Your telemetry is yours. The AI Coach is guidance, not a guarantee: you are always responsible for how you drive.

1. Your account

  • OAT requires a free Overcut Academy account. You can create one in the App, or sign in with an existing Vault (vault.overcutacademy.com) account.
  • Give accurate details, keep your password to yourself, and tell us at support@overcutacademy.com if you think someone else has used your account. You are responsible for activity under your account.
  • You must be at least 18, or use OAT through an account held by a parent, guardian or coach who accepts these Terms for you.
  • One account per person. Accounts may not be shared or resold.

2. Licence to use OAT

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to install and use OAT for your own driving, coaching or team operations. All rights not expressly granted are reserved.

You may not (a) copy, modify, or create derivative works of the App; (b) reverse engineer, decompile, or disassemble it except to the limited extent permitted by law; (c) rent, lease, sublicense, resell, or share your account, subscription or licence key; or (d) remove proprietary notices.

3. Free and Pro plans

  • Free. Importing and analysing sessions is free, with the limits shown on the OAT page (for example, a monthly number of comparisons and AI Coach analyses). We may change what Free includes; we will not charge for Free without your agreement.
  • Pro. Pro is a subscription at US$29 per month or US$290 per year, plus any taxes that apply, and includes the features listed on the OAT page. Pro is bought from inside OAT (Account → Try Pro), where you choose monthly or yearly.
  • Overcut Academy members. Pro may be included with an Overcut Academy membership; in that case it lasts as long as the membership and these billing terms do not apply to it.
  • AI Coach credits. Hosted AI analyses use credits. Plans include a monthly allowance that resets each month; credit packs, if you buy them, are described at the point of sale. Credits have no cash value and cannot be transferred.

4. The 30-day free trial

  • Card required. To start the trial you enter a payment card on Stripe’s checkout. You are not charged during the trial.
  • It becomes a paid subscription. When the 30 days end, the trial converts automatically to the plan you chose and your card is charged, unless you cancel before the trial ends. If you cancel during the trial, Pro keeps working until the trial ends and you are not charged.
  • One trial per person. Each person gets one free trial, counted per account and per card. An account that has already had a trial checks out without one. If a card that has already been used for an OAT trial is used to start another, that new subscription is cancelled at once, nothing is charged, Pro is not granted, and we email you; you can still subscribe without a trial from inside OAT.
  • We may end a trial obtained by getting around these rules.

5. Billing, renewal and cancellation

  • Billing. Payments are processed securely on our behalf by our payment provider Stripe. After the trial, payment is charged at the start of each monthly or yearly period.
  • Auto-renewal. Your subscription renews automatically until you cancel. By subscribing you authorise recurring charges to your payment method.
  • Cancellation. You may cancel anytime inside OAT: open your account menu and choose Manage subscription, which opens Stripe’s secure page where you can cancel, update your card and see your invoices. You can also cancel by emailing support@overcutacademy.com from your account’s email address; we confirm the cancellation by email. Cancellation takes effect at the end of the current trial or paid period; Pro keeps working until then.
  • Failed payments. If a renewal payment fails, Pro may be suspended until payment succeeds. Free features keep working.
  • Price changes. We may change prices; changes apply to future renewal periods and we’ll give notice as required by law.

6. Refunds

  • 14-day money-back guarantee. If Pro isn’t right for you, request a full refund within 14 days of your first Pro charge (the charge when your trial converts, or your first purchase if you subscribed without a trial). This applies once per customer and to the first charge only, not to later renewals.
  • Renewals are non-refundable. To avoid a renewal charge, cancel before the renewal date. Except where required by law, we do not refund or prorate the unused part of a paid period after cancellation. Credit packs are non-refundable once used.
  • Statutory rights and incorrect charges. Nothing here limits any non-waivable refund or withdrawal rights you have under applicable consumer law (for example, the Brazilian Consumer Protection Code or the statutory right of withdrawal in the EU/UK). We also refund duplicate charges, charges after a valid cancellation, charges you did not authorise, and cases where Pro does not work and we cannot fix it.
  • How to ask. Email support@overcutacademy.com from your account’s email address. Approved refunds are issued through Stripe to your original payment method.

7. Acceptable use

You agree to use OAT lawfully and not to: interfere with or overload the Service; attempt to circumvent sign-in, plan limits, credit metering, the one-trial rule or licence enforcement; access dashes, files or accounts you are not authorised to use; upload or publish content you have no right to share, or that is unlawful or abusive; or use the hosted AI Coach to build a competing service or to extract its models or prompts. You represent that you own, or are authorised to use, the dashes and telemetry you use with OAT.

8. Your data

Your telemetry, videos, reports and notes are yours. OAT reads and stores them on your own computer. When you use a feature that sends data to us — a hosted AI analysis, publishing to Vault, or team sync — you give us permission to process that data only to provide that feature. We claim no ownership of it. How we handle personal data is described in our Privacy Policy.

9. AI Coach and analysis are guidance, not a guarantee

OAT’s analysis, comparisons and AI Coach (built-in and hosted) are coaching suggestions based on data that can be incomplete or wrong (for example, GPS error, missing channels or a mislabelled file), and AI-written text can contain mistakes. They do not guarantee any lap time, result or improvement.

Motorsport is dangerous and can cause serious injury or death. You, and where applicable the driver’s parent, guardian or coach, are solely responsible for every decision made on track: braking points, lines, speeds, kart setup and whether a suggestion is safe for the driver, the vehicle, the conditions and the circuit. Always follow the circuit’s rules, the officials’ instructions and your own judgement. We are not liable for driving decisions or their consequences.

10. Intellectual property

OAT, the OAT and Overcut Academy names, and all associated software and content are owned by Nogueira Driver Development LTDA (Overcut Academy). “Mychron” and “AiM” are trademarks of AiM Tech S.r.l.; “Unipro” and “UNIGO” are trademarks of Unipro ApS; other product names belong to their respective owners. OAT is an independent product and is not affiliated with, endorsed by, or sponsored by these companies or their brands.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted or error-free, that every file or dash will be read correctly, or that its analysis is accurate.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, ANY PERSONAL INJURY OR PROPERTY DAMAGE ARISING FROM DRIVING OR RACING, OR ANY LOSS OF DATA, PROFITS, RESULTS OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. Nothing in these Terms excludes liability that cannot be excluded by law.

13. Suspension and termination

We may suspend or close your account, or end Pro, if you breach these Terms, if a chargeback or payment dispute is opened, or if your subscription lapses. You may stop using OAT at any time by cancelling any subscription and uninstalling, and you can ask us to delete your account. Sections that by their nature survive termination (data, IP, disclaimers, liability, governing law) survive.

14. Governing law

These Terms are governed by the laws of the Federative Republic of Brazil. Any dispute arising out of or in connection with these Terms will be resolved in the competent courts of the Comarca de Belo Horizonte, Minas Gerais, Brazil. Nothing in these Terms limits any non-waivable consumer rights you have under applicable law, including the Brazilian Consumer Protection Code (Lei nº 8.078/1990).

15. Changes

We may update these Terms from time to time. Material changes will be reflected by an updated effective date and, where they affect what you agreed to, we will ask you to accept them again in the App or tell you by email. Continued use after changes take effect constitutes acceptance.
